Travel Terms & Conditions 2019

General Terms & Conditions

These Terms and Conditions should be read carefully and apply when we are the organiser of your package including travel by air and a cruise.   Unless booking cruise only, your contract is with Rivers & Roads a division of OVATION Travel ABN 44 143 376 443, a company registered in Australia whose offices are at Level 3, 27 Belgrave Street Manly NSW 2095, Australia.  A contract will exist when we have accepted a deposit and issued our confirmation invoice.

Bookings, Deposit and Final Payment

To make a booking please contact Rivers & Roads on 02 9977 3900 or 1300 662 995, email receptionovationtravel.comau, visit website www.Amadeus-rivercruises.com.au, or contact your preferred travel agent.  A booking is made with Rivers & Roads when you notify us that you would like to accept our written or verbal quotation and you pay us a deposit.

A minimum deposit of 30% of the total holiday cost is required at the time of booking, unless advised differently at time of booking.  In addition to the deposit, payment for flights and other services may be required and may also be non-refundable.  When we issue you with a Confirmation Invoice, a binding contract is created.

The remaining balance must be paid no later than 90 days prior to the embarkation or departure date.  Bookings made less than 60 days prior to the embarkation or departure date must be paid in full on confirmation of the booking.  If the balance is not paid in time, we reserve the right to cancel the booking and retain the deposit.


Pricing

The “from” package prices include estimated flight costs and are a guide, and we reserve the right to alter any of our advertised package prices. 

The price of the package does not include visas, and/or government charges for entering and leaving any of the countries included in the itinerary, that will be paid directly by you if required by the local authorities, tourist charges for accommodation, excess luggage, vaccination certificates, on board laundry service, wi-fi on board, or excursions except where specifically stated as included.  We reserve the right to amend the price of unsold holidays at any time and correct errors in the prices of confirmed holidays within 7 days of the booking.


Travel Insurance

We reserve the right to refuse or cancel a booking if you do not have personal travel insurance. We will treat any cancellation for this reason as a cancellation by you and the cancellation charges will be payable as set out below. Please read your policy details carefully and take them with you on holiday. It is your responsibility to ensure that the insurance you purchase is adequate and appropriate for your particular needs, and covers all travel, cancellation, medical, and repatriation liabilities for the holiday. We reserve the right to request full details of your insurance policy, however please note that we do not check insurance policies for suitability.


Passport, Visa, Immigration and Medical Requirements

It is your responsibility to check and fulfil the passport, visa, health and immigration requirements applicable to your itinerary. You must check requirements for your own specific circumstances with the relevant Embassy and/or Consulate and your own doctor as applicable. Your passport must be valid for at least 6 months after your return date. If your passport is in its final year, you should check with the relevant Embassy. 


Cancellation

If you or any other member of your party decides to cancel your confirmed booking, you must notify us in writing. Your notice of cancellation will only take effect when we receive it in writing at our offices at Rivers & Roads. Please note proof of postage (whether Australia Post, private courier or e-mail) is not proof of receipt. You will be responsible for applicable cancellation charges.


Disabled Passengers

You are required to advise us in writing, at or prior to the time a holiday is booked, of any physical, emotional or mental condition which may require professional attention during the holiday, including those passengers who are physically challenged and require the use of wheelchairs or other similar facilities.  All vessels and coaches are equipped to European standards.  Vessel operators will, under appropriate circumstances, permit passengers to use motorised scooters and wheelchairs that satisfy criteria confirmed by Amadeus River Cruises.  In all cases passengers must understand and accept that the vessels do not have lifts permitting easy access from deck to deck, and that some decks are multi-level and/or have significant thresholds to be negotiated.  Accordingly, physically disabled passengers may need the services of a responsible adult, and should be aware that crew availability to assist them is often severely limited.


Children/Minors

Due to the nature of the cruise itineraries, Amadeus River Cruises does not maintain facilities or services for children aboard their cruise vessels.  On all cruises and cruise journeys, minors under the age of 18 must be accompanied and share a cabin with a parent, legal guardian or other responsible adult over the age of 21. We regret that we cannot accommodate children under 12 years of age, and we reserve the right to limit the number of minors under the age of 18 years on board.


Complaints

If a problem occurs whilst you are on holiday, you must inform the relevant supplier immediately so that the matter can be put right. If the supplier cannot resolve the problem to your satisfaction at the time, you must also contact us or your travel agent immediately by so that we are given the opportunity to help. In the event that a complaint cannot be resolved at the time, you must write to us within 28 days of return to Australia quoting the original booking reference and giving all relevant information. PLEASE NOTE: Failure to take these steps will hinder our ability to resolve the problem and/or investigate it fully and in consequence, your rights under the contract may be affected. We regret we cannot accept liability for any claims that are not notified to ourselves and/or our suppliers strictly in accordance with this clause.


Special Requests

Any special requests must be advised to us at the time of booking. You should then confirm your requests in writing. Whilst every effort will be made by us to try to arrange your reasonable special requests, we cannot guarantee that they will be fulfilled.


Jurisdiction

When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. A contract will exist as soon as we issue our Confirmation Invoice. This contract is made on the terms of these booking conditions, which are governed by Australian Law.


Data Protection and Privacy

Personal details will be held and processed by us to enable fulfilment of the holiday contract.  You hereby agree to this information being passed to any third parties in order for the supply of the holiday.  Personal details supplied to us may also be used for marketing purposes but only with your clear, active consent.  We will not disclose personal details to third parties for marketing purposes without express permission.  Our full Privacy Policy can be provided on request.


American Express Membership Rewards

Certain American Express card holders can redeem their membership rewards as American Express dollars for full or part payment. 10,000 points = $100. Please speak with your consultant for further information. Once points are redeemed they are non-refundable. If travel is cancelled, value of points (after normal cancellation fees and rules taken into consideration) can be held as a credit for future travel.
